DMCA Compliance & Copyright Takedown Policy
CMC Sisters respects intellectual property rights and fully complies with the Digital Millennium Copyright Act (DMCA) and all applicable international copyright laws. This page outlines the procedures for submitting copyright complaints and other legal content removal requests.
๐ Requirements for Valid DMCA Takedown Notices
To ensure prompt processing of your copyright infringement claim, your notice must include all of the following elements. Incomplete submissions will not be acted upon:
- Complete contact information: Your full legal name, physical mailing address, telephone number, and email address.
- Identification of copyrighted work: Clear description of the original work you claim has been infringed, including titles, registration numbers if available, or URLs to the legitimate source.
- Exact location of infringing material: Specific URL(s) on our website where the allegedly infringing content appears. General descriptions or search terms are insufficient.
- Good faith statement: A declaration that you have a good faith belief the use is not authorized by the copyright owner, their agent, or applicable law.
- Accuracy statement under penalty of perjury: Confirmation that the information in your notice is accurate and that you are the copyright owner or legally authorized to act on their behalf.
- Physical or electronic signature: Your handwritten signature or a legally recognized electronic signature.
Notices that fail to meet these statutory requirements cannot be processed under DMCA safe harbor provisions. We encourage copyright holders to use professional legal counsel when preparing formal takedown requests.
๐ Counter-Notice Procedure
If you believe content you submitted was removed in error or due to misidentification, you may file a counter-notice. Your counter-notice must include:
- Your full contact information (name, address, phone, email)
- Identification of the removed material and its original location before removal
- A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
- Your consent to jurisdiction of the federal district court in your district (or our operator's district)
- Agreement to accept service of process from the original complainant
- Your physical or electronic signature
Upon receipt of a valid counter-notice, we will forward it to the original complainant. If no court action is filed within 10-14 business days, the removed material may be restored. All counter-notices are handled with the same level of scrutiny as initial takedown requests.
โ๏ธ Other Legal Removal Requests
For content removal based on legal grounds other than copyright infringement, please specify the basis and provide supporting documentation:
- Privacy violations: Unauthorized sharing of personal information, doxxing, non-consensual intimate imagery
- Defamation: False statements damaging to reputation (court orders may be required)
- Trademark infringement: Unauthorized use of registered brand names or logos
- 2257 compliance concerns: Suspected underage models or missing age verification records
Each request is reviewed individually. Additional information may be requested before action is taken. We prioritize matters involving potential legal violations or user safety concerns.
โฑ๏ธ Processing Timeline
Complete and valid DMCA notices are processed within 1-3 business days. Upon action, we notify both the complainant and the affected user. We maintain detailed records of all takedown requests and cooperate fully with legal authorities. Complex cases or requests requiring additional verification may take longer to resolve.
๐ Repeat Infringer Policy
Users who repeatedly violate copyright laws or submit fraudulent notices will have their access permanently terminated and may be reported to relevant authorities in accordance with 17 U.S.C. ยง512(i). We maintain strict records to identify patterns of infringement and take appropriate action to protect the rights of content creators.
All correspondence regarding copyright matters should be directed to our designated DMCA agent. Fraudulent or abusive submissions may result in legal liability under 17 U.S.C. ยง512(f). We take these obligations seriously and encourage good-faith communication from all parties.
